Justice Karnan 'Directs' CBI to Investigate SC Judges, 'Stays' Warrant

Just after a seven judge bench of the Supreme Court headed by the Chief Justice issued a bailable warrant to the Calcutta High Court Judge Justice CS Karnan for refusing to appear before the court in relation to the contempt proceedings against him, Justice Karnan has now passed an order directing the CBI to investigate all the seven judges of the apex court.

New Delhi: Just after a seven judge bench of the Supreme Court headed by the Chief Justice issued a bailable warrant to the Calcutta High Court Judge Justice CS Karnan for refusing to appear before the court in relation to the contempt proceedings against him, Justice Karnan has now passed an order directing the CBI to investigate all the seven judges of the apex court.

Addressing the media, Justice Karnan agreed that this was indeed an unparallel instance in the Indian judicial history.

"Yes, this has never happened before just like the SC order which issued bailable warrant against me. It is all happening after the current government has come to power and the lower class is being further oppressed and suppressed," said Justice Karnan.

Karnan has now directed the Director of the CBI to register, investigate and file a report before the CBI court in Delhi against all the seven judges who passed the bailable warrant and also Attorney General Mukul Rohatgi who pleaded for such an order.

"This order has been passed by me to prevent abuse of any court. I have invoked my inherent power under Section 482 of the Criminal Procedure Code and Article 226 of the Indian Constitution. There will be inquiry to see that if they have violated the provisions of not only SC & ST (Prevention of Atrocities) Act, 1989 but also the Indian Penal Code," he said.

It is important to note that Justice Karnan was stripped of his judicial and administrative power by the SC bench in February but even then the Calcutta High Court judge did not take such an order into consideration.

He has further directed the Secretary General of Lok Sabha to place the entire facts of the case before the speaker of the Lok Sabha so that inquiry under the Judges Inquiry Act can be initiated and proceedings of impeachment against the SC judges can be carried out.

"I have also requested the President to stay the bailable warrant issued by the SC today," said Justice Karnan.

While Justice Karnan maintained that "SC is a separate constitutional office than the High Court and one constitutional office cannot stand in the way of another constitutional office," he said that he was being singularly targeted by the higher judiciary for being a Dalit.

"Learned Senior Advocate Shanthi Bhushan had filed an affidavit before the SC stating that nine former Chief Justices of the SC were guilty of corruption, but the affidavit is still pending and no contempt action against her. Why? Because he belongs to the upper caste. They are doing this to ruin my life and career," said Justice Karnan.

He also said that a month ago, an advocates association gave a press statement that a Judge of the Karnataka High Court, Justice Kumaraswamy was paid Rs 200 crores for passing a favourable verdict in the Jayalalithaa case and questioned as to why there was no contempt order against them.

On February 8, SC had taken a suo motu action to initiate contempt proceedings against the sitting judge of the Calcutta High Court when the court took note of the letters that the judge had written in which he had levelled serious allegations against several sitting and retired judges.

Today a seven-judge bench comprising of CJI J.S. Khehar, Justice Dipak Misra, Justice Chelameshwar, Justice Ranjan Gogoi, Justice MB Lokur, Justice PC Ghose and Justice Kurian Joseph, was extremely displeased with constant disregard that Justice Karnan had shown towards an order of the SC and hence passed the bailable warrant against the Calcutta HC Judge.
