Prajapati Arrested. But What About 107 New UP MLAs Facing Serious Charges?

New Delhi: Rape accused Samajwadi Party leader Gayatri Prajapati has been arrested after evading arrest for 17 days. However, 26% of MLAs just elected have serious criminal cases registered against them.

As many as 107 of the 403 Members of the Legislative Assembly have cases ranging from murder and attempt to murder, according to data released by the Association for Democratic Reforms. Moreover, 143 MLAs (or 36%) have criminal cases registered against them.

What distinguishes a criminal case from a serious criminal case are the following: offence for which the maximum punishment is five years or more; a non-bailable offence; assault, murder, kidnap, rape related offences etc.

“What the data shows is that democracy is being mocked by political parties when they give tickets to people with criminal cases against them,” Jagdeep Chhokar, a founding member of the Association for Democratic Reforms, told News18.

Chhokar said that it is not necessary that an MLA with a serious criminal case must necessarily be under bars because they may have obtained bail or the arrest may not have been called for. The person may have been convicted and acquitted or served his sentence.

As many as 34 MLAs have declared attempt to murder cases while eight have murder cases against them. One MLA has a case related to crimes against women. A party-wise breakup of serious criminal cases reveals that 83 of the Bharatiya Janata Party’s 312 legislators have serious criminal cases, while the figure for the Samajwadi Party stands at 11 out of 46 MLAs. The corresponding figures for the BSP are four out of 19 and Congress one of seven MLAs.

The data was compiled from the affidavits that the candidates filed along with their nominations.
