Supreme Court Refuses to Hear Justice Karnan's Bail Plea

The Supreme Court on Wednesday refused to entertain former Calcutta HC Judge CS Karnan’s plea seeking bail and suspension of the six-month sentence awarded to him.

New Delhi: The Supreme Court on Wednesday refused to entertain former Calcutta HC Judge CS Karnan’s plea seeking bail and suspension of the six-month sentence awarded to him.

A vacation bench of Justices D Y Chandrachud and S K Kaul said the court was duty-bound by the order of the seven-judge bench on the case and Karnan should mention the matter before a bench of the chief justice, PTI reported.

The seven-judge bench had already passed an order and only the special bench could hear the plea, the judges said.

Justice Karnan was on Tuesday arrested in Tamil Nadu's Coimbatore. He was arrested by the West Bengal police.

Earlier, Supreme Court had issued an arrest order against him for his defamatory remarks against the top court's collegium system.

On June 12, Justice Karnan became the first sitting High Court judge to retire in absentia after he eluded the Supreme Court arrest order, also sentencing him to six months in jail for contempt.

The order was passed by no less than seven senior-most judges in the top court and Director General of Police, West Bengal, had been ordered to ensure the HC judge is made to serve the sentence.

When Karnan was being held guilty under the Contempt of Courts Act, Chief Justice of India J S Khehar, who was heading the seven-judge bench, said that he wanted to send out a message loud and clear that judiciary will not hesitate to act against even one of its own.

A seven-judge special bench of the Supreme Court had also ordered the Director General of Police, West Bengal, to medically examine Justice Karnan. Justice Karnan had termed this order as “ridiculous and unusual”.

But on May 4, Karnan declined to undergo a mental health checkup as ordered, telling a team of doctors that he was “absolutely normal”.

In the wake of the controversial issue, Union Law Minister Ravi Shankar Prasad had said that Justice Karnan episode calls for a greater scrutiny of the judiciary.



Justice Karnan appeared before the Supreme Court on March 31 in connection with the contempt proceeding, becoming the first high court judge to do so in the history of Indian judiciary.
