New Delhi: The Gujarat High Court has ordered a CBI probe against the Junagadh government hospital after 23 thalassaemic children were infected by HIV during blood transfusion at the state-run Hospital.

A bench comprising Chief Justice Bhaskar Bhattacharya and JB Pardiwala, while handing over the case to the CBI, expressed dissatisfaction over the way in which the case was handled by the Gujarat authorities. 
 
It observed that Sarvodaya Blood Bank, from which the blood was sourced, operated from within the government hospital premises even without having a licence and that it figured on the list of licenced blood banks on the government website too. 
 
This blood bank is run by BJP MLA Mahendra Mashru. Two of the 23 children who contacted HIV have since died. 
 
The High Court has ordered that all investigations papers in the case be handed over immediately to the CBI. The case came to light in September last year when the children undergoing blood transfusion tested positive for HIV. 
 
Girish Das said, “The High Court has observed that perhaps it has not happened ever before in India that 23 children were affected by HIV in a government hospital and since this is a rarest of rare case, it warrantees a CBI investigation.”
