Should Restaurants Not Passing GST Rate Cut to Consumers be Penalised?

Some restaurants seem to have hiked their prices after the GST rate on food bills was reduced from 18 percent to 5 percent. CNN-News18 has access to two bills before and after the rate cut which shows that 13 percent drop in tax was not passed on to the consumers. Should the government penalise these restaurants?
