New Delhi: In a big setback for the Congress, Attorney General Mukul Rohatgi has opined that the party is not eligible for the post of Leader of Opposition in the Lok Sabha. The A-G has cited a 1956 convention which stipulates that a party must have 10 per cent strength in the House to stake claim to the post. 
 
"There is no precedence where a party was given the LOP position without meeting the criteria of 10 per cent of seats since the days of the first Lok Sabha," Rohatgi said. 
 
It is a bigger blow for the Congress since party President Sonia Gandhi herself stepped into the fight for the post. Claiming the post she said that it is the UPA's numbers which should be taken into account and that it's a violation of democracy. 
 
"There is political merit, there is legal merit, there's ethic and moral merit to give the seat of opposition to the second largest party in the House. It would be keeping with the times and to deny the Congress that right would be unjust," Congress leader Manish Tewari said. 
 
The Congress hopes to make itself relevant by at least getting the LOP post which is also a Cabinet rank, but more importantly the LOP post would entitle it to be a part of the panel choosing important positions like the CVC and the Lokpal. 
 
But the Bharatiya Janata Party agrees with the Attorney General's opinion. "The A-G is the highest advising authority to the government. Therefore, it will be very difficult for the Speaker to give the LOP position to the Congress, " said BJP MP Rajiv Pratap Rudy. 
 
The Congress has yet to recover from its dismal defeat which has reduced it to 44 seats. But a loss of the LOP post will damage its efforts further to bounce back. Hence, it prefers to play the martyr card, accusing the BJP of political vendetta.
