New Delhi: A day after the Supreme Court ruled that no sanction is needed to prosecute former MPs accused of corruption, Parliamentarians spoke out against judicial ‘over-activism’. 
 
Lok Sabha Speaker Somnath Chatterjee said the House would hold a wide debate on whether the judiciary is interfering with legislative powers and how the two branches can function harmoniously. 
 
Chatterjee took the consent of the House to convert the call attention motion by CPI member Gurudas Dasgupta into a full-fledged discussion. 
 
Raising the issue in a calling attention motion, Dasgupta charged there were "interventions" by the judiciary on issues which were under the "exclusive domain of the executive”. 
 
 
"Even legislative intentions are being subjected to judicial scrutiny," he said. 
 
After taking permission of the House, the Speaker said the matter would be taken up for a detailed discussion. Dasgupta argued that there was "lack of harmony" between the three organs of the State: the legislature, the judiciary and the exective. 
 
BJP Deputy Leader V K Malhotra said the matter was "very sensitive" and suggested the Prime Minister should convene a meeting of leaders of all parties to evolve a unanimous view. 
 
The Supreme Court on Wednesday ruled that for prosecuting former MPs, MLAs and other chief ministers in corruption no prior sanction is needed. 
 
Dasgupta cited from speeches by Prime Minister Jawaharlal Nehru to prove that the judiciary cannot challenge the supremacy of Parliament. He alleged that there has been "judicial over-activism" in the country of late. 
 
Law Minister H R Bhardwaj said the Constitution clearly demarcates the powers of the three organs. "Each one of the organs is accountable in one form or the other. The checks and balances are functioning in harmony for the common goal of the good of the people who are the framers of the Constitution," he said. 
 
He said all the three organs of the State have "by and large functioned within their determined sphere demarcated by the Constitution. It is a matter of pride for all of us that our democracy is vibrant and alive." 
 
Dasgupta said the minister had made a "lame-duck statement".
